Blagojevich rescinds HB4050

A little bit of news sneaked out of the Governor's office this weekend. The Governor has directed the llinois Department of Financial and Professional Regulation (IDFPR) to “immediately suspend” the Illinois Predatory Lending Database Pilot Program, also known as HB 4050.

We see some delight in the defeat of this bill on the part of bloggers that look at foreclosures as "investment" opportunities. I'll be interested to see what the grass roots say on this.....

HB4050 why?

I talked with Sue Hofer at the Illinois Department of Professional Regulation, and she said the transcripts and documents from the recent hearings on the state HB4050 pilot (some would say 'brouhaha') will be released soon, after they have been 'cleaned' up. I'm looking forward to seeing them.

Meanwhile, when RealtyTrac announced
numbers
on foreclosures in Chicago, I asked them to do a special run on the HB4050 zip codes.

Context on ARMs and HB4050

Here’s some excellent reporting from Business Week that provides useful context on the big picture nationwide related to the controversial use of adjustable rate mortgages (ARMs) by individuals and the real estate industry. The cover story ran Sept. 11, 2006.

Business Week’s "Map of Misery," shows the percentage of new and refinanced mortgages carrying loans with payment options. The map shows that 7.8% of Chicago’s loans appear to carry these kinds of payment options. This is a low percentage compared with the much higher percentages in other areas nationwide, such as 27.5% in Los Angeles/Long Beach.

The use and abuse of ARMs is front and center in the reasons why the HB4050 law was passed.

Public Meeting on HB4050 Nov. 27

The Illinois Department of Financial and Professional Regulation has posted rules on its
website for people who want to testify at a public meeting next Monday.

You will be required to:
1) fill out a witness slip
2) provide a written copy of your statement in advance of testifying
3) limit your oral comments to 5 minutes.

Housing Action Illinois "Get the Facts" on 4050

This document from Housing Action Illinois explains what triggers the counseling in the affected zip codes and the procedure from there.

Housing Action Illinois is a statewide affordable housing coalition. It is a nonprofit member-based organization with 175 agencies, some of which are providing counseling for the program.

The quagmire that is 4050

Today we choose our mortgages from 150 different products vs. a handful a decade ago. Today you can buy a house with $500 down -- for better or for worse.

I'm not a fan of trying to legislate personal action. That's how we get into quagmires like HB4050. The fact is each of us is obligated to understand the exact terms of our mortgage.

That's why here at the Sun-Times Real Estate section, we'll try to stay out of the fray, and instead do what we do best: provide information and tools that are useful to you as a homebuyer, homeseller and homeowner.

Among those tools is this: The Right Place, our blog that will bring you information as quickly as it comes to us, and in an unfiltered form. If you go there today, you'll be able to read statements from the mortgage brokers, homebuilders and Realtors, and reach your own conclusion or not -- about the usefulness of the law. We're watching how this one rolls out.
